TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE

These Terms and Conditions (“Terms”) govern the relationship between Future Leaders Education and Charitable Trust, operating as Krityam Montessori Preschool and Daycare (“Krityam,” “we,” “us,” or “our”), and parents/guardians (“you,” “your,” or “Parent”) who enroll their children in our Montessori education programs, daycare services, and related activities (collectively, “Services”).

By enrolling your child with Krityam, submitting an application, making any payment, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Pricing Policy, which are incorporated herein by reference. These Terms constitute a legally binding agreement. If you do not agree to these Terms, you must not enroll your child or use our Services.

2. DEFINITIONS

For the purposes of these Terms, “Child” or “Student” refers to the enrolled child receiving Services from Krityam. “Parent” or “Guardian” refers to the legal parent, guardian, or authorized representative of the Child. “Services” includes Montessori education, daycare, extended care, meal programs, transportation, and all related activities. “Academic Year” refers to the period from April to March of the following year. “School Hours” refers to regular operational hours as determined by Krityam. “Extended Care” refers to daycare services beyond regular school hours. “Premises” refers to the Krityam facility and all associated areas.

3. ENROLLMENT AND ADMISSION

3.1 Enrollment Process

Enrollment is confirmed only upon submission of completed application forms with all required documentation and payment of applicable fees. Services are available for children aged 6 months to 6 years. Enrollment is subject to availability and management approval. All required documents must be submitted before commencement of Services.

3.2 Admission Requirements

Current immunization records, medical examination reports, and health certificates are required for enrollment. Complete emergency contact details and medical information must be provided. Signed pickup authorization, medical emergency consent, and photo/video consent forms are mandatory. Payment of all applicable admission and initial fees as per our Pricing Policy must be completed before enrollment confirmation.

4. EDUCATIONAL SERVICES

4.1 Montessori Program

Krityam follows authentic Montessori principles and practices as established by Maria Montessori. Our prepared environments are designed for children aged 6 months to 6 years, with programs tailored to each child’s developmental needs and pace. All programs align with Indian Montessori Training Course (IMTC) standards, ensuring the highest quality of authentic Montessori education.

4.2 Daily Schedule

Standard program hours are communicated during enrollment, with flexible scheduling available through extended care for working parents with additional fees. Academic calendar including holidays and breaks is provided annually. Krityam reserves the right to modify schedules with appropriate notice to families.

4.3 Curriculum and Assessment

Our curriculum emphasizes independence, practical life skills, sensorial development, language, and mathematics. Regular observation and documentation of each child’s progress is conducted by our qualified teachers. Regular updates are provided through reports, conferences, and daily communications. Individual portfolios documenting each child’s learning journey are maintained and shared with families.

5. FINANCIAL TERMS

5.1 Fee Structure

All financial obligations are governed by our separate Pricing Policy, which forms an integral part of these Terms. Key provisions include quarterly payments due on 15th May, 15th August, and 15th November, or annual payment by 15th May. All fees are strictly non-refundable under any circumstances. Late payment fee of INR 100 per day applies after a 3-day grace period. Automatic suspension occurs after 10 days of payment default.

5.2 Additional Charges

Optional services including meal programs, transportation, and extended care are subject to additional fees. Special activities such as field trips, special events, and additional programs are offered with separate charges. Replacement costs apply for lost or damaged school property. Administrative fees may be charged for processing special requests or document replacements.

5.3 Financial Assistance

Limited financial assistance may be available based on demonstrated need and fund availability, subject to annual review and performance standards.

6. HEALTH AND SAFETY

6.1 Health Requirements

Current medical examination and immunization records are required for enrollment. Parents must immediately notify Krityam of any changes in their child’s health status. All medications must be provided with written instructions and proper authorization. Children with fever, contagious conditions, or other health concerns must remain home until cleared for return.

6.2 Emergency Procedures

Krityam staff are authorized to seek immediate medical attention for any child in emergency situations. Updated emergency contact information must be maintained at all times. Parents authorize Krityam to transport children to designated hospitals when necessary. Health information may be shared with medical professionals during emergencies to ensure appropriate care.

6.3 Safety Protocols

Children are supervised by qualified staff at all times during school hours. We maintain 24/7 security monitoring, controlled access, and CCTV surveillance for safety. Children will only be released to authorized individuals with proper identification. All incidents, accidents, or injuries are documented and reported to parents immediately.


6.4 COVID-19 and Health Emergencies

We maintain compliance with all government health guidelines and safety protocols. Daily health screening including temperature checks may be required. Immediate isolation and parent notification procedures are in place for any child showing symptoms. Vaccination requirements are implemented as mandated by health authorities. Alternative service delivery methods may be implemented during health emergencies.


7. BEHAVIORAL EXPECTATIONS AND DISCIPLINE

7.1 Montessori Principles

All behavior guidance follows Montessori principles of respect and natural consequences. Behavior support is tailored to each child’s developmental level and needs. We maintain a collaborative approach between home and school for consistent expectations. Access to specialized support is provided when needed for behavioral challenges.


7.2 Unacceptable Behavior

Any behavior that poses risk to the child or others may result in immediate intervention. Ongoing behavioral challenges are addressed through individual behavior plans. Required cooperation from parents is expected in addressing behavioral concerns. Recommendation for professional assessment or support may be provided when appropriate.


7.3 Termination for Behavioral Reasons

Krityam reserves the right to terminate enrollment if a child’s behavior poses ongoing safety risks to themselves or others, if required behavioral interventions are unsuccessful despite reasonable efforts, if parents fail to cooperate with recommended behavioral support strategies, or if professional assessment indicates that Krityam cannot meet the child’s needs.


8. ATTENDANCE AND WITHDRAWAL

8.1 Attendance Requirements

Consistent attendance is essential for optimal learning and development. Parents must notify Krityam of any planned or unexpected absences. Absences exceeding 15 consecutive days may result in enrollment review. Fees are not adjusted for absences, holidays, or temporary closures.


8.2 Withdrawal Procedures

A 30-day written notice is required for voluntary withdrawal. Complete clearance from all departments is required before final withdrawal. All fees paid are non-refundable regardless of withdrawal timing or reason. Student records are provided upon request after completion of withdrawal process.


8.3 Involuntary Termination

Krityam may terminate enrollment for non-payment of fees as per Pricing Policy, violation of these Terms or school policies, behavioral concerns that cannot be adequately addressed, health or safety concerns that cannot be reasonably accommodated, or failure to provide required documentation or cooperation.


9. COMMUNICATION AND TECHNOLOGY

9.1 Communication Channels

The LilTriangle app serves as our primary platform for daily communication, progress reports, and administrative updates. Official communications are sent via registered email addresses. Phone contact is maintained for emergency communication and urgent matters. Regular scheduled conferences and additional meetings are arranged as needed.


9.2 Digital Platform Usage

Parents are responsible for maintaining security of digital account credentials. Digital platforms are to be used only for intended educational and communication purposes. All communication must be respectful and appropriate for the educational environment. Limited technical support is available for platform-related issues.


9.3 Information Updates

Parents must immediately update any changes to contact information. Current emergency contact information is required at all times. Updates to authorized pickup persons must be submitted in writing. Immediate notification of any changes to health or medical information is mandatory.


10. PHOTOGRAPHY AND MEDIA

10.1 Consent and Usage

Separate consent is obtained for photography and videography of children. Photos and videos are used for developmental documentation and assessment. With explicit consent, images may be used for promotional materials. School social media content is shared with appropriate privacy settings.


10.2 Media Guidelines

All media content maintains respect for child dignity and privacy. Strict controls are maintained on sharing of child photos and videos. Parents may withdraw media consent at any time with written notice. No commercial use of child images occurs without specific additional consent.


10.3 Third-Party Media

Outside photography during school events is subject to prior authorization. External media coverage requires advance notice and consent. Child privacy is protected in all media interactions.


11. SPECIAL EVENTS AND ACTIVITIES

11.1 School Events

All school events are optional unless specified as part of core curriculum. Some events may require additional fees as communicated in advance. Children must be accompanied by parents/guardians during family events. All behavioral and safety expectations apply during events.


11.2 Field Trips and Excursions

Written authorization is required for all off-site activities. Transportation arrangements include school-arranged transportation or parent transportation as specified. Enhanced emergency procedures are implemented for off-site activities. Activities are subject to cancellation due to weather or safety concerns.


11.3 External Celebrations

Simple, healthy birthday celebrations are encouraged with advance coordination. We celebrate diverse cultural and religious traditions. All food items must comply with school dietary policies. Special consideration is given for children with food allergies.


12. PROPERTY AND PERSONAL BELONGINGS

12.1 School Property

12.1.1 Montessori Materials and Equipment

Montessori materials are specifically designed educational tools requiring respectful handling. Materials are to be used only by appropriate age groups under supervision. Children are taught to handle materials with care and return them to designated places. Full replacement cost is charged for damaged or lost Montessori materials, as these materials are of professional quality and expensive to replace.


12.1.2 Facility and Infrastructure

Prepared environments designed for optimal learning must be maintained. Child-sized furniture and fixtures require gentle use. Computers, tablets, and audio-visual equipment are for educational use only. Fire safety, first aid, and security equipment must not be tampered with. Outdoor equipment is used only under supervision and for intended purposes.


12.1.3 Books and Learning Resources

School library books must be handled with care and returned on time. Educational resources including workbooks, art supplies, and craft materials are provided by the school. Access to educational software and digital content is available for learning purposes. Educational magazines, activity guides, and assessment tools are maintained for program use. Montessori reference books and parent education resources are available for family support.

12.1.4 Damage and Replacement Policy

Any damage to school property must be reported immediately to staff. Damage assessment is conducted by administration within 48 hours. Families have 15 days to replace or pay for damaged items. Normal wear and tear from appropriate use is not subject to replacement charges. Deliberate damage may result in additional disciplinary action.


12.2 Personal Items and Belongings

12.2.1 Permitted Personal Items

Small comfort items such as blankets and stuffed animals are allowed for rest time. Appropriate clothing, shoes, hats, and weather gear are welcomed. Lunch boxes, water bottles, and healthy snacks are permitted as per school policy. Prescription medications, inhalers, and medical devices require proper authorization. Sunscreen, jackets, boots, and seasonal clothing are encouraged as needed.


12.2.2 Prohibited Items

Mobile phones, tablets, gaming devices, and electronic toys are not permitted except with special authorization. Valuable items including jewelry, expensive accessories, money, or collectibles are discouraged. Any items that could be used to harm others or self are strictly prohibited. Violent toys and character toys promoting inappropriate behavior are not allowed. Chemicals, medicines except prescribed, or potentially dangerous items are forbidden. Tree nuts, peanuts, or items containing common allergens require prior approval.


12.2.3 Labeling and Identification

All personal items must be clearly labeled with the child’s full name. Labels must be permanent and weather-resistant for outdoor items. Emergency contact information should be included on expensive items. Parents are encouraged to maintain lists of items sent to school. Labels should be checked and updated regularly, especially for growing children.

12.2.4 Liability Limitations

Krityam assumes no responsibility for loss, theft, or damage to personal items. Personal property insurance is recommended for valuable items. Staff will exercise reasonable care but cannot guarantee security of personal items. Limited secure storage is available for valuable items during school hours. Increased risk of loss during field trips and special events is acknowledged.


12.3 Lost and Found Management

12.3.1 Collection and Storage

A central lost and found area is accessible to parents and staff. Items are collected daily from classrooms and common areas. A sorting system organizes items by type and size for easy identification. A log is maintained of items with description and date found. Valuable items are stored securely with immediate parent notification.


12.3.2 Retrieval Process

Parents are encouraged to check lost and found weekly. Staff assistance is available to help locate missing items during office hours. Items are released only to parents or authorized pickup persons. A 30-day holding period applies for regular items, with 60 days for valuable items. Parents are notified before disposal of unclaimed items.


12.3.3 Seasonal Considerations

Special attention is given to jackets, boots, and winter gear. Sunhats, swimwear, and summer clothing receive focus during warm months. Costumes and special event clothing are stored separately. Comprehensive checking and notification occurs before summer break. A fresh start with clean lost and found begins at the start of each academic year.


12.3.4 Disposal and Donation

Unclaimed items in good condition are donated to local charities. Damaged items are disposed of in an environmentally responsible manner. Donation receipts are available for parents claiming tax benefits. The donation process involves children in community service learning. Last opportunity notices are sent before disposal.


12.4 Clothing and Dress Code

12.4.1 Appropriate Clothing

Comfortable clothes that allow freedom of movement and play are encouraged. Clothing should be manageable by children independently for toileting and dressing. Weather-appropriate attire suitable for outdoor play and weather conditions is expected. Safety considerations include non-slip shoes and appropriate coverage for playground activities. Respectful attire that honors diverse cultural backgrounds is welcomed.


12.4.2 Clothing Care and Responsibility

Parents are responsible for ensuring appropriate daily clothing. Extra clothing sets are kept at school for emergencies. Soiled clothes are sent home in sealed bags for hygiene purposes. The school maintains emergency clothing supply for accidents. Regular updates to spare clothing ensure seasonal appropriateness.

12.5 Food and Meal Items

12.5.1 Personal Food Items

Clearly labeled lunch boxes and containers are required. Families are encouraged to bring nutritious, balanced meals and snacks. Strict adherence to allergy policies and restrictions is mandatory. Celebration and inclusion of diverse cultural food traditions is welcomed. Age-appropriate portions that children can manage independently are recommended.


12.5.2 Food Safety and Hygiene

Cold foods must be kept cold with proper insulation required. Fresh food only is accepted, with no expired items permitted. Safe, non-toxic containers and utensils only are allowed. Food sharing is monitored for allergy safety. Children are taught to clean up after meals independently.


12.6 Technology and Digital Devices

12.6.1 School Technology Policy

School technology is reserved for educational purposes only. All technology use is supervised by qualified staff. Content is filtered and appropriate for early childhood. Limited, purposeful screen time is provided aligned with Montessori principles. Early introduction to responsible technology use is incorporated.


12.6.2 Personal Device Restrictions

Personal electronic devices are generally not permitted during school hours. Medical devices or communication aids may be approved case-by-case. If brought to school, devices must be stored securely during the day. The school is not liable for damage to personal electronic devices. Emergency communication occurs through the school phone system.


12.7 Emergency and Medical Equipment

12.7.1 Personal Medical Items

Prescription medications are stored securely with proper authorization and instructions. Inhalers, glucose monitors, and other medical equipment are properly maintained. EpiPens and emergency medications are readily accessible to trained staff. Current medical forms and action plans must be on file. Medical information and supplies are updated as needed.


12.7.2 School Emergency Equipment

Emergency equipment and supplies are kept away from children. Emergency equipment is inspected and maintained regularly. All staff are trained in use of emergency medical equipment. Immediate replacement occurs for used or expired emergency supplies. Clear procedures exist for accessing emergency equipment during incidents.


13. TRANSPORTATION SERVICES

13.1 Transportation Authorization

A separate agreement is required for transportation services. Pickup and drop-off locations are predetermined and specified in the service agreement. Punctuality is required for pickup and drop-off times. All transportation safety protocols must be followed by families and staff.


13.2 Transportation Safety

All drivers are properly licensed and background-checked. Regular maintenance and safety inspections are conducted on all vehicles. Specific emergency procedures are established for transportation incidents. Real-time communication is maintained during transportation delays or issues.\


13.3 Transportation Policies

Transportation fees are specified in the service agreement. Advance notice is required for any schedule modifications. School behavioral expectations apply during transportation. Transportation services may be terminated for safety violations.


14. PRIVACY AND CONFIDENTIALITY

14.1 Privacy Protection

All privacy matters are governed by our separate Privacy Policy, which forms an integral part of these Terms. Key provisions include information collection limited to educational and safety purposes, comprehensive security measures to protect all personal information, information sharing only with authorized personnel and approved service providers, and parent rights including access, correction, and deletion rights as specified in the Privacy Policy.


14.2 Confidentiality Obligations

All staff are bound by confidentiality agreements regarding student and family information. Confidentiality requirements are extended to all service providers. Confidential treatment of all educational and developmental information is maintained. Secure storage and handling of all student records is ensured.


14.3 Information Sharing

Information is shared among staff for educational planning and child development purposes. Health and safety information is shared during emergencies as necessary. Compliance with mandatory reporting and legal obligations is maintained. Additional sharing occurs only with explicit parental consent.


15. LIABILITY AND INSURANCE

15.1 Limitation of Liability

Krityam provides reasonable supervision and care during school hours. Parents acknowledge inherent risks in educational and play activities. No liability is assumed for loss, theft, or damage to personal belongings. Limited liability applies for services provided by third-party vendors.


15.2 Insurance Requirements

Parents are solely responsible for personal accident and health insurance. Personal property insurance is the responsibility of families. Krityam maintains appropriate institutional liability coverage. Parents must maintain adequate medical insurance for their children.


15.3 Indemnification

Parents agree to indemnify Krityam against claims arising from their child’s actions. Responsibility for any property damage caused by enrolled children rests with families. Cooperation is required in defense of any legal claims. Indemnification is limited to reasonable and foreseeable circumstances.


15.4 Exceptions to Liability Limitations

Nothing in these Terms shall limit Krityam’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.


16. FORCE MAJEURE AND EMERGENCY SITUATIONS

16.1 Force Majeure Events

16.1.1 Definition and Scope

Krityam shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters and environmental emergencies such as earthquakes, floods, cyclones, storms, or other severe weather conditions, fires, volcanic eruptions, landslides, or other geological events, environmental contamination, toxic spills, or air quality emergencies, power outages affecting large areas or extended duration, and water supply disruptions or infrastructure failures.

Public health emergencies include pandemic declarations by WHO, national, or state health authorities, epidemic outbreaks requiring closure of educational institutions, infectious disease outbreaks requiring quarantine or isolation measures, public health advisories restricting educational activities, and government-mandated health and safety protocols affecting operations.

Government and legal actions encompass government orders, regulations, or emergency declarations, court orders or legal injunctions affecting school operations, changes in licensing or regulatory requirements, educational policy changes mandating operational modifications, and immigration or visa restrictions affecting staff or operations.

Security and safety threats include acts of terrorism, war, or civil unrest, security threats to the school premises or community, crime incidents affecting school safety, bomb threats or other emergency evacuations, and community violence or public safety emergencies.

Infrastructure and technology failures comprise internet or telecommunications system failures, transportation system disruptions affecting school access, banking or payment system failures, essential utility failures including electricity, water, and gas, and technology infrastructure failures affecting operations.


16.1.2 Force Majeure Procedures

Immediate response includes immediate assessment of situation and safety of children and staff, activation of emergency response protocols and communication systems, coordination with local authorities and emergency services, secure facility lockdown or evacuation as appropriate, and parent notification through all available communication channels.

Ongoing management involves regular situation monitoring and risk assessment updates, continuous communication with families regarding status and plans, coordination with government authorities and health officials, implementation of alternative service delivery methods when possible, and staff deployment and resource management during emergency situations.

Recovery planning encompasses development of recovery and reopening plans, facility safety assessment and remediation when needed, staff and resource readiness evaluation, gradual service resumption based on safety clearance, and post-emergency evaluation and protocol improvement.


16.2 Service Modifications During Emergencies

16.2.1 Alternative Service Delivery

Virtual learning options include online Montessori activities and guided learning sessions, virtual parent-child interaction classes, digital sharing of educational materials and resources, online parent education and support sessions, and virtual individual consultations with teachers and staff.

Modified on-site services encompass reduced capacity operations with enhanced safety protocols, modified schedules to accommodate safety requirements, enhanced cleaning and sanitization procedures, outdoor learning environments when appropriate, and staggered pickup and drop-off times.

Home support services include educational material delivery to homes, telephone and video consultation services, emergency childcare for essential workers when possible, mental health and emotional support resources, and nutrition guidance and meal planning assistance.


16.2.2 Communication During Emergencies

Communication protocols involve primary communication through LilTriangle app and email, secondary communication via phone calls and text messages, emergency website updates and social media notifications, coordination with local media for community-wide announcements, and regular scheduled updates even when no new information is available.

Information sharing includes timely updates on facility status and safety measures, clear explanation of any service modifications or limitations, health and safety protocol communications, resource sharing for home learning and support, and mental health and wellness resources for families.

Feedback and support encompasses regular family surveys to assess needs and concerns, individual family consultations for specific needs, community support coordination and resource sharing, staff availability for questions and concerns, and crisis counseling and emotional support referrals.


16.3 Health Emergency Protocols

16.3.1 Pandemic and Infectious Disease Response

Preparation and prevention involves development and maintenance of pandemic response plans, staff training on infectious disease prevention and response, stockpiling of necessary health and safety supplies, coordination with local health authorities for guidance, and regular facility sanitization and air quality management.

Active response measures include health screening protocols for children and staff, isolation procedures for symptomatic individuals, contact tracing and notification procedures, enhanced cleaning and disinfection protocols, and modified activities to reduce transmission risk.

Recovery and monitoring encompasses gradual reopening based on health authority guidelines, ongoing health monitoring and symptom surveillance, continued enhanced safety measures during recovery phase, support for families affected by health emergencies, and documentation and reporting as required by health authorities.


16.3.2 Individual Health Emergencies

Medical emergency response includes immediate medical attention and emergency service contact, parent notification and hospital transportation when necessary, documentation of incident and medical response actions, follow-up care coordination and return-to-school protocols, and support for child and family during recovery period.

Serious injury or illness procedures involve first aid administration by trained staff members, professional medical evaluation and treatment coordination, incident investigation and prevention measure implementation, insurance coordination and documentation support, and emotional support for affected children and families.


16.4 Security and Safety Emergencies

16.4.1 Facility Security Threats

Threat assessment and response includes immediate threat evaluation and appropriate response activation, law enforcement coordination and cooperation, facility lockdown or evacuation procedures as appropriate, parent notification and communication protocols, and post-incident counseling and support services.

Ongoing security measures encompass enhanced security protocols during elevated threat periods, coordination with local law enforcement agencies, staff training on emergency response and threat recognition, regular security system maintenance and upgrades, and community awareness and safety education programs.


16.4.2 Environmental and Safety Hazards

Hazardous material response involves immediate area evacuation and child safety prioritization, emergency services coordination and professional remediation, health monitoring and medical evaluation when necessary, facility assessment and safety clearance before reopening, and parent education on environmental safety measures.

Structural or equipment failures require immediate area isolation and alternative space arrangement, professional inspection and repair coordination, safety protocol implementation during repair period, insurance claim processing and documentation, and preventive maintenance enhancement to avoid future incidents.


16.5 Financial and Operational Considerations

16.5.1 Fee Obligations During Emergencies

Continued financial obligations include all fee obligations continuing as specified in Pricing Policy, no automatic fee reductions or refunds for service interruptions, alternative service delivery maintaining full fee obligations, additional costs for enhanced safety measures not passed to families, and financial assistance evaluation for families experiencing hardship.

Payment accommodations encompass extended payment deadlines during declared emergencies, payment plan options for families facing financial hardship, coordination with payment processors for technical difficulties, documentation requirements for emergency payment accommodations, and return to normal payment schedule upon emergency resolution.


16.5.2 Operational Cost Management

Emergency expense management includes additional costs for safety equipment and enhanced protocols, staff overtime and emergency staffing costs, technology and infrastructure modifications for alternative service delivery, professional cleaning and sanitization services, and legal and consulting costs for emergency response.

Insurance and recovery involves institutional insurance claim processing for covered losses, business interruption insurance coordination when applicable, government assistance program participation when available, vendor and supplier coordination for emergency services, and financial planning for sustained emergency response.


16.6 Closure and Reopening Procedures

16.6.1 Temporary Closure Protocols

Closure decision making follows a safety-first approach to all closure decisions, consultation with relevant authorities and health officials, staff and family notification within maximum 2 hours of decision, facility security and property protection measures, and documentation of closure reasons and expected duration.

During closure period, regular facility monitoring and maintenance continues, staff coordination and communication maintenance is preserved, family support services and resource provision is maintained, emergency contact availability and response capability is ensured, and ongoing situation monitoring and reopening planning occurs.


16.6.2 Reopening Procedures

Safety assessment and clearance includes comprehensive facility safety inspection and clearance, staff health screening and readiness evaluation, safety protocol implementation and staff training, supply and equipment readiness verification, and government and regulatory approval when required.

16.7 Legal and Regulatory Compliance

16.7.1 Government Directive Compliance

Mandatory compliance requires immediate compliance with all government emergency orders, educational authority directive implementation, health department requirement adherence, emergency services coordination and cooperation, and legal consultation for complex compliance requirements.

Reporting and documentation involves required reporting to government agencies and authorities, incident documentation and record maintenance, insurance claim documentation and processing, legal documentation for liability protection, and regulatory compliance verification and certification.


16.7.2 Liability and Legal Protection

Emergency liability limitations include force majeure protection for performance failures due to emergencies, government directive compliance defense, reasonable care standard maintenance during emergencies, documentation of all emergency response actions and decisions, and legal counsel consultation for emergency response decisions.

Insurance and risk management encompasses comprehensive institutional insurance coverage maintenance, risk assessment and mitigation strategy implementation, professional liability and emergency response coverage, property and casualty insurance coordination, and legal defense coverage for emergency response actions.


17. DISPUTE RESOLUTION

17.1 Internal Resolution

Initial disputes are addressed through direct communication with appropriate staff. Escalation to administration occurs for unresolved concerns. Final internal review is conducted by senior management. We maintain commitment to good faith efforts for amicable resolution.


17.2 Mediation

Voluntary mediation is available as an option for complex disputes. Qualified educational or commercial mediators are utilized. Mediation costs are shared equally unless otherwise agreed. Mediated settlements are binding on all parties.


17.3 Legal Proceedings

Exclusive jurisdiction rests with courts in Bengaluru, Karnataka, India. All matters are governed by Indian law. The prevailing party may be entitled to reasonable legal costs. All claims must be brought within one year of accrual.


18. MODIFICATIONS AND AMENDMENTS

18.1 Terms Modifications

Krityam reserves the right to modify these Terms with appropriate notice. Minimum 30 days notice is provided for material changes. Notice is provided via email, app notification, and website posting. Continued enrollment constitutes acceptance of modified Terms.


18.2 Policy Integration

These Terms incorporate our Privacy Policy and Pricing Policy. Updates to related policies may affect these Terms. In case of conflict, the most recently updated document prevails. These Terms and related policies constitute the complete agreement.


18.3 Individual Modifications

Individual modifications must be in writing and signed by authorized representatives. Individual modifications do not affect Terms for other families. Only authorized management personnel may approve modifications.


19. GENERAL PROVISIONS

19.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.


19.2 Waiver

Failure to enforce any provision does not constitute a waiver of that provision. Waivers must be in writing and signed by authorized representatives. Waivers apply only to specific instances and do not affect future enforcement. No course of dealing creates implied waivers or modifications.


19.3 Assignment

Krityam may assign these Terms in connection with business transfers. Parents may not assign their rights or obligations under these Terms. Terms are binding on successors and permitted assigns. Written notice is provided for any assignment by Krityam.


19.4 Entire Agreement

These Terms, together with the Privacy Policy and Pricing Policy, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements relating to the subject matter.


19.5 Counterparts and Electronic Signatures

These Terms may be executed in counterparts and electronic signatures shall be deemed valid and enforceable.


20. ACKNOWLEDGMENT AND AGREEMENT

20.1 Parental Acknowledgment

By enrolling your child with Krityam Montessori Preschool and Daycare, you acknowledge and agree that you have read, understood, and agree to be bound by these Terms and Conditions, you understand and accept the non-refundable fee policy, you authorize emergency medical treatment for your child when necessary, you consent to the collection and use of personal information as outlined in our Privacy Policy, you understand your obligations regarding health, safety, and behavioral expectations, and you acknowledge the inherent risks in educational and play activities.


20.2 Legal Capacity

You represent and warrant that you have the legal authority to enroll the child and enter into these Terms, all information provided is true, complete, and accurate, you will promptly update any changes to information provided, and you understand the financial obligations and have the ability to meet them.


20.3 Emergency Authorization

You specifically authorize Krityam to seek emergency medical treatment for your child when necessary, share medical information with healthcare providers during emergencies, transport your child to medical facilities when required, and make reasonable decisions regarding your child’s immediate safety and welfare.
